Harvey Weinstein, 74, faced a third New York trial on one count of third-degree rape involving Jessica Mann, stemming from an alleged assault in a Manhattan hotel room in 2013. [1, 2, 3, 4]
The trial began in April 2026 and ended on May 15, 2026, when Judge Curtis Farber declared a mistrial after the jury deadlocked following three days of deliberations. [1, 2, 3, 5, 6, 7, 8] The jury was majority male and initially instructed to continue deliberations before the judge ended the trial. [1]
Mann testified that Weinstein raped her despite her repeated refusals, though she said they had some prior consensual encounters. [1, 2, 3, 5, 6, 8] She recalled Weinstein offering support early on and complimenting her, telling her she was prettier than actress Natalie Portman and buying her acting books, but later their relationship turned abusive. [5, 6, 8] Weinstein pleaded not guilty, denying any assault or non-consensual sex. His lawyers argued Mann fabricated the allegations after a failed consensual romance. [1, 2, 3, 4]
This follows a 2020 conviction for this same charge that was overturned on appeal due to trial irregularities, and a 2025 trial that also ended in a mistrial after jury infighting. [1, 2, 3, 5, 6, 8] Weinstein is currently serving a 16-year sentence from a 2022 California rape conviction and last June was convicted for sexually abusing Miriam Haley, facing up to 25 years for that conviction. [2, 3, 5, 6]
Manhattan District Attorney Alvin Bragg said, "While we are disappointed that the proceedings ended with a mistrial, we deeply respect the jury system and sincerely thank all of the jurors for their time and dedication. For nearly a decade, Jessica Mann has fought for justice." [5]
Weinstein's spokesman Judah Engelmayer said defense polling showed nine of 12 jurors favored acquittal, indicating "significant reasonable doubt here," though this was not independently verified. [5, 6, 8] He added the DA's office should focus on "actual violent crime, chaos, and public safety issues impacting New Yorkers every day." [5]
The Manhattan District Attorney’s Office has 30 days to decide whether to pursue a fourth trial on the New York rape charge. [8]
