US District Judge Paul Engelmayer denied Ghislaine Maxwell’s petition to overturn her 2021 conviction on sex trafficking charges related to Jeffrey Epstein on August 25, 2026. [1, 2, 3, 4] Maxwell is serving a 20-year prison sentence after being convicted in December 2021 for recruiting and sexually abusing underage girls for Epstein. [1, 2, 3, 5] She is currently held at a minimum-security camp in Bryan, Texas, with earliest release eligibility in 2037. [1, 3]
Maxwell filed her habeas petition in December 2025, citing constitutional violations at trial, suppression of evidence, and new documents released under the Epstein Files Transparency Act passed in November 2025. [1, 2, 3] The law required disclosure of investigative records Maxwell used to argue for her innocence. [3] However, Judge Engelmayer found these new materials "far from exculpating her, it incriminates her or reinforces the correctness of the legal rulings Maxwell challenges." [3]
The judge’s 67-page ruling called Maxwell’s claims "meritless, and generally based on speculation, distortions, and/or outright falsehoods," adding most arguments were procedurally barred. [2] He also noted her contradictory statements regarding involvement in Epstein’s operations weakened her case. [1, 3]
Maxwell’s efforts to overturn her conviction have largely been exhausted, including the US Supreme Court’s refusal to hear her appeal in October 2025. [3, 5] Her remaining legal options are limited to clemency or a presidential pardon. [4, 5] Former President Donald Trump, who had social ties to Maxwell and Epstein, has declined to clarify whether he would grant any such relief, stating, "I wouldn’t consider it or not consider it—I don’t know anything about it." [4]
In February 2026, Maxwell was subpoenaed by the US House Oversight Committee to testify about Epstein but refused to answer questions without a pardon. [1, 5]
With Judge Engelmayer’s ruling now final, Maxwell’s petition is denied, closing a major legal avenue. She remains imprisoned with no new court filings pending as of August 2026. [1, 4]
